Terms of Use — Huge Win Media

1. Acceptance of terms

The website hugewinmedia.com (the "Site") is operated by Huge Win Media. By accessing the Site you agree to these Terms of Use. If you do not agree, do not use the Site. You must be at least 18 years old to use the Site.

2. License to use the Site

We grant you a limited, non-transferable, non-exclusive, revocable license to access the Site for your personal, non-commercial use. You may not:

Sell, rent, lease, transfer, or otherwise commercially exploit the Site
Create derivative works, reverse engineer, or disassemble any part of the Site
Use the Site to build a competing service
Copy, reproduce, or redistribute content without prior written permission

All copyright notices must be retained on any permitted copies.

3. Intellectual property

Except for content you provide, all intellectual property rights in the Site and its content (including text, graphics, logos, design, code, case studies) are owned by Huge Win Media or our licensors. We grant you no rights other than the limited access granted in these Terms.

4. Third-party links

The Site may link to third-party sites or display third-party content. We do not endorse or take responsibility for them. Access them at your own risk and review their terms.

5. Disclaimers

The Site is provided "as is" and "as available". We disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

We do not warrant that the Site will be uninterrupted, timely, secure, error-free, or free of viruses. Where applicable law requires warranties, they are limited to ninety (90) days from your first use.

6. Limitation of liability

To the maximum extent permitted by law, Huge Win Media and our suppliers are not liable for lost profits, lost data, indirect, incidental, consequential, or punitive damages arising from your use of the Site.

Our maximum aggregate liability under these Terms is capped at fifty US dollars (US$50). You use the Site at your own discretion and risk.

7. Service engagements

Use of the Site does not create a client engagement. Client engagements are governed by a separate Statement of Work (SOW) or contract signed by both parties. Service-specific terms (pricing, deliverables, refund policy, IP ownership, confidentiality) are detailed in that SOW. If there is a conflict between the SOW and these Terms, the SOW controls.

8. Copyright complaints

We respect intellectual property. To report alleged copyright infringement on the Site, email emma@hugewinmedia.com with:

Your physical or electronic signature
Identification of the work allegedly infringed
Identification of the infringing material and your request to remove it
Your address, phone, and email
A good-faith statement that the use is unauthorized
A statement under penalty of perjury that the above is accurate

Misrepresentations subject the complaining party to liability for damages, costs, and attorney fees.

9. Termination

These Terms remain in effect while you access the Site. We may suspend or terminate your access at any time. Sections 2–6 and 8–12 survive termination.

10. Dispute resolution

Any dispute arising from these Terms that cannot be resolved informally or in small claims court shall be resolved through mandatory binding arbitration on an individual basis under the rules of the American Arbitration Association (AAA). You and Huge Win Media waive the right to a jury trial and to participate in class actions.

Either party may seek emergency equitable relief in court. Claims excluded from arbitration include defamation, Computer Fraud and Abuse Act violations, and intellectual property infringement claims.

11. Changes to these Terms

We may revise these Terms occasionally. Substantial changes will be notified by email or a prominent notice on the Site, and become effective thirty (30) days after notice. Continued use of the Site after changes means you accept them.
